Conveyancing solicitors will be all too aware of the potential consequences of not undertaking a Chancel Repair Search on a property. However, these are not an inexpensive product and in some cases may not be required.
Parish Liability Search will allow you to ascertain if the property falls within a parish, which is subject to liability, at a fraction of the cost of a Chancel Repair Search.
Parish Liability Search results will determine if you require a full Chancel Repair Search, or take advantage of insurance cover offered as protection against potential liability.
The results of the Parish Liability Search will be presented in one of three formats.
No potential Liability
Potential Liability
Potential Liability – excluded parishes
No Potential Liability – Certifies that there is not a substantial risk that the property is subject to Chancel Liability under IR104/107-108 in the Record on Ascertainment.
The results also include the option for your client to request insurance cover
Potential Liability – Records of Ascertainment under IR104/107-108, confirming that the property falls within a parish that is affected by Chancel Repair Liability.
This search recommends that your client undertake one of two options. Insuring the risk of liability or the request for a discounted full Chancel Repair Search.

Included within the Parish Liability Search results of all three options are an application form for insurance liability cover and an application for a full Chancel Repair Search.
Insurance Liability Cover
Insurance is available for all three products. The level of cover for the property is the choice of the client and is determined by the level of premium paid. Five levels of cover are available.
The five options of liability insurance are valid for a period of 25 years. If your client believes at the time of purchase that they could move within that period, they have the option of requesting ‘successor cover’. This will provide the same levels and period of cover afforded to those with standard liability insurance, but has the advantage of being transferable to a future new owner.
This would provide a unique selling point, as the standard cover would terminate once the original policyholder completes on the sale of the property.
Excluded Parishes
There are twenty-one parishes, which have been deemed to carry a higher risk of liability. If the subject property falls within one of these high-risk parishes, the results will reflect this and you will be offered the opportunity of requesting a Chancel Repair Search or insurance cover. If the option is insurance, the locality of the property will exclude it from the usual five options of cover and will require an individual quotation from the insurer broker, on both the level of cover afforded to the property and the cost of the premium.
